NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN SUNSET IDEA HOUSE SHOWROOM SHOWDOWN

1.      ELIGIBILITY. Sunset Idea House Showroom Showdown is open to individuals who are eighteen (18) years of age or older as of August 7^th, 2015, and a legal resident of Colorado.

FirstBank employees, its advertising agency, and their immediate family members are not eligible to enter or win. Each entrant, by participating in Sunset Idea House Showroom Showdown, agrees to be bound by these Official Rules and the Sponsor’s decisions.

2.      TIMING. Sunset Idea House Showroom Showdown begins August 7^th, 2015 at 12:01am MT and ends September 13^th, 2015 at 5:00pm MT (the “Promotion Period”).

3.      HOW TO ENTER AND WIN.

a.      Eligible participants may enter by visiting the FirstBank Rooftop Deck at the Sunset Idea House located at 5131 E 1st Avenue, Denver, CO 80220, and submit and entry form containing a guess of the actual retail price of the rooftop deck furnishing and décor (Decking and Awning NOT included), first and last name, telephone number and email address. Only one (1) entry per person for the duration of the Promotion Period will be accepted. Incomplete and duplicate entries will be void. Eligible participants may win only once during Promotion Period.

b.      You do not need to be a current customer of Sponsor or use the Sunset Idea House Showroom Showdown entry form to enter the Sunset Idea House Showroom Showdown. To enter without completing the entry form, print by hand your first and last name, complete mailing address, email address, telephone number, date of birth and the words “FirstBank – Sunset Idea House Showroom Showdown” on a plain 3” x 5” piece of paper and mail it in a sealed, stamped and hand-written #10 envelope to FirstBank – Sunset Idea House Showroom Showdown, Attn: Marketing Department, 12345 W. Colfax Avenue, Lakewood, CO 80215. Limit one entry per person during Promotion Period. Entries must be received no later than September 13^th, 2015. No photocopied, computer generated facsimiles, mechanically reproduced, or mass entries permitted. Your Sunset Idea House Showroom Showdown entry and/or your submission of a 3” x 5” mail-in entry constitutes your consent to participate in the Sunset Idea House Showroom Showdown and your consent for Sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this Sunset Idea House Showroom Showdown. Entries dropped off at Sponsor banking branches will not be accepted.

4.      CONDITIONS. An eligible entrant may only enter via the registration methods as described above. Incomplete entries are void. By entering, entrants acknowledge compliance with these Official Rules including all eligibility requirements. All entries become the property of the Sponsor and will not be returned. No substitutions or transfer of prize permitted.

5.      CONSUMER DISCLOSURE: PRIZE DESCRIPTION. You have not yet won.   Winner agrees that one (1) Grand prize consisting of the rooftop deck furnishings and décor (Decking and Awning NOT included) will be awarded. Value of prize is based on the actual retail price and will not exceed $12,500. Winner agrees that he/she shall not sell, resell, auction, barter, assign, exchange, place in commerce, transfer, give away, donate, or otherwise convey any of the rooftop deck furnishings and décor that is received as a prize. Prize will not be honored if these restrictions have been violated. All costs and expenses associated with the prize acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals, beverages, gratuities and other expenses incurred by accepting the prize are the sole responsibility of the winner. All prize winners, should they be selected, agree to be bound by the terms and conditions of the promotion as provided by the Sponsor.

6.      DETERMINATION OF WINNERS. The Sunset Idea House Showroom Showdown Winner will be the person who guesses the actual retail value of the prize or the closest guess without going over.  Winner will be announced on September 14, 2015. In the event of a tie, a winner will be randomly selected. Winner may decline the prize and then the next closest guess without going over will be the alternate winner.  A person or household may only win one (1) prize during the Sunset Idea House Showroom Showdown. Prize will be delivered to the winner within 14 business days.

Odds of winning depend upon the number of eligible entries received. Winner will be notified by telephone and/or regular mail and/or email. Any attempt to deliberately damage the content or operation of this Sunset Idea House Showroom Showdown is unlawful and subject to legal action by the Sponsor. Sponsor’s selection of the winner is binding and conclusive. Winner agrees to the use by Sponsor and its designees of their name, city and state and photograph/likeness for advertising, promotional and other purposes, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet) without additional compensation, except where prohibited by law.

7.      RULES REQUESTS. To receive a copy of the Official Rules, send a self-addressed, stamped envelope to: FirstBank – Sunset Idea House Showroom Showdown Official Rules, Attn: Marketing, 12345 W. Colfax Avenue, Lakewood, CO 80215.

8.      TAXES. All applicable federal, state and local tax associated with winning a prize in the Sunset Idea House Showroom Showdown will be the sole responsibility of the winner. The winner shall be provided a 1099 form for income tax purposes.

9.      LIMITATIONS ON LIABILITY AND DISCLAIMERS. By participating in the Sunset Idea House Showroom Showdown, entrants, agree to release, indemnify and hold harmless Sponsor from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Sunset Idea House Showroom Showdown or acceptance, possession, use, misuse or nonuse of the prizes (including, without limitation, any travel or travel-related activity thereto) that may be awarded. Sponsor is not responsible for technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Sunset Idea House Showroom Showdown, including, without limitation, errors which may occur in connection with the administration of the Sunset Idea House Showroom Showdown, the processing of entries, the announcement of the prizes or in any Sunset Idea House Showroom Showdown related materials; or for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, delayed or illegible entries or postage due entries or mail; or for electronic, computer, or telephonic malfunction error, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, or human or other error. If in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sunset Idea House Showroom Showdown, or if computer viruses, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sunset Idea House Showroom Showdown, the Sponsor at its sole discretion reserves the right to disqualify any individual who tampers with the entry process and/or void any entries submitted fraudulently, to modify or suspend the Sunset Idea House Showroom Showdown, or to terminate the Sunset Idea House Showroom Showdown. As a condition of entering the Sunset Idea House Showroom Showdown, entrants, or if a minor, their parents or legal guardians agrees that; a) under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b) all causes of action arising out of or connected with this Sunset Idea House Showroom Showdown or the prize awarded, shall be resolved individually, without resort to any form of class action; and c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred and in no event shall entrant be entitled to receive attorney’s fees or other legal costs. Sponsor reserves the right to modify prize award procedures. As used in this section, “Sponsor” means the Sponsor named in section 11 below and its officers, directors or board members, agents, representatives, and employees.

10.  GOVERNING LAW. This Sunset Idea House Showroom Showdown and these Official Rules shall be interpreted in accordance with the laws of the State of Colorado without regard to its principles of conflicts of law and jurisdiction and venue shall be solely within the State of Colorado. This Sunset Idea House Showroom Showdown is subject to all applicable federal, state and local laws. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
